These General Terms and Conditions of Sale (the "GTC") govern the sale of items presented on the Marionnette.fr website (the "Website") by La Vivandière, a limited liability company registered with the Romans Trade and Companies Register under number 514 175 736, with its registered office at 7 allée de la Forêt - 26110 Nyons - FRANCE, with intra-Community VAT number FR46 514 175 736 (hereinafter referred to as "La Vivandière").

Preamble

These Terms and Conditions are entered into between La Vivandière and any non-commercial individual wishing to make a purchase through the website (the "Customer").

These Terms and Conditions govern the sale of all items featured on the website (hereinafter the "items"). Any order placed on the Marionnette.fr website implies the Customer's acceptance of these Terms and Conditions.

La Vivandière reserves the right to modify the Terms and Conditions at any time. However, these new Terms and Conditions will not apply to transactions already in progress at the time they take effect.

If any provision were to be found invalid, it would be deemed to be governed by the practices in force in the distance selling sector for companies headquartered in France.

1. Price

All product prices are listed in euros, excluding shipping costs. Shipping costs are shown to the customer when placing an order, once the items have been added to the cart.

The price of the item is payable in full and in a single payment. The items remain the property of La Vivandière until full payment has been received.

2. Order

Customers who wish to purchase a product from the online store must:

• Select one or more items and add them to your cart,
• Proceed to checkout,
• Check all the information on the order summary,
• Read and accept these terms and conditions,
• Make the payment online in accordance with the terms and conditions,
• Confirm your order and payment.

Once the final click to place the order has been made, the order is considered confirmed. Once the order has been processed, a confirmation email is sent to the user, including a summary of the items ordered and the shipping address.

If an ordered item is unavailable, the Customer will be notified by email.

However, in certain cases—such as multiple customer accounts, orders with unusually large quantities, excessive exchanges or returns, existing disputes, non-payment, incorrect addresses, or other account issues—La Vivandière reserves the right to hold the Customer’s order until the issue is resolved.

3. Consent

Any order placed on the website by the Customer and confirmed by La Vivandière via email shall be binding on the Customer as irrefutable and complete proof of such order, as well as confirmation of the Customer’s acceptance of these Terms and Conditions of Sale.

It is agreed between La Vivandière and the Customer that emails shall serve as proof between the two parties, as shall the website’s automatic backups, particularly with regard to the order date.

4. Payment

Payment for the order can be made using one of the following methods:

• Cash payment by credit card (Carte Bleue, e-Carte Bleue, Visa, Mastercard)
• Secure PayPal payment (using a credit card or PayPal account)

The Customer must provide their credit card number, the expiration date, and the last three digits of the number on the back of the card.

Transactions on the Marionnette.fr website are processed securely through Crédit Agricole’s Up2pay online payment platform. Up2pay ensures optimal security for your data by using SSL encryption to secure all payment-related information. Up2pay e-Transactions is also certified as compliant with the PCI-DSS standard. At no time are your bank details displayed in plain text or shared with La Vivandière.

Secure payment via PayPal

When selecting PayPal as the payment method, the Customer will be automatically redirected to their PayPal account. Once the PayPal payment has been confirmed, they can complete their order on the website.

5. Delivery

Products sold on Marionnette.fr can be shipped to mainland France.

The products will be delivered to the address the customer provided when placing the order on the website.

Orders are shipped within 24 to 48 hours (business days), unless otherwise specified in the product description or your confirmation email.

Shipping method

Delivery will be made according to the customer's choice of one of the following delivery methods:

• Mondial Relay Pickup Point®
• Colissimo Home Delivery (no signature required)
• Colissimo Home Delivery with Signature

Once the package has been shipped, the buyer will receive an email confirming shipment, including a tracking number that will allow them to track the package online.

La Vivandière cannot be held responsible for delivery delays caused by third-party service providers.

Mondial Relay Pickup Point®

€3.50 (including tax) for orders totaling €49 or less (including tax)
Free shipping for orders totaling more than €49 (including tax)

When placing your order, you can select a Point Relais® location near you. Once your package has been shipped, you will receive an email confirming its shipment. The average delivery time is 3 to 4 business days. You will then receive a notification when your package arrives. You will have 7 days to pick up your package at your Point Relais®.

Colissimo Home Delivery (no signature required)

€6.90 (including tax) for orders totaling €49 or less (including tax)
€3.90 (including tax) for orders totaling more than €49 (including tax)

For Colissimo Home Delivery without signature, your package will be delivered within approximately 48 hours, directly to your mailbox. If your mailbox is not large enough and you are not home, a delivery notice will be left, allowing you to choose a new delivery date online within 6 business days or to pick up your package starting the next day at 3:00 PM at the post office of your choice. If you do not make a selection, you can then pick up your package at your local post office within 15 days.

Colissimo Home Delivery with Signature

€7.80 (including tax) for orders totaling €49 or less (including tax)
€4.80 (including tax) for orders totaling more than €49 (including tax)

Once we have prepared your package, it will be delivered to you within approximately 48 hours and delivered upon signature. If you are not home, a delivery notice will be left for you, allowing you to choose a new delivery date online within 6 business days or to pick up your package starting at 3:00 PM the next day at the post office of your choice. If you do not make a selection, you may pick up your package at your local post office within 15 days.

6. Returns

(a) Right of withdrawal

The Customer has the right to cancel the contract established by our written order confirmation without giving any reason within one hundred (100) days from the date of receipt of the order. To cancel the contract and return the products, the Customer may contact our Customer Service and follow the instructions provided, or send us a clear written statement, such as a letter to La Vivandière, 7 allée de la Forêt, 26110 Nyons, or an email to contact@marionnette.fr.

(b) Return process

Products may only be returned to the following address: Marionnette.fr, La Vivandière, 7 allée de la Forêt, F26110 Nyons.

The cost of returning the product is the buyer’s responsibility. The Customer must retain proof of return shipment, and we assume no liability if the Customer is unable to provide such proof. Only merchandise received by our online store will be eligible for a refund.

(c) Product Return Policy

For any return, the Customer must include the product in the package along with all its accessories, the Warranty Card, and all other documents, in their original box. We reserve the right to refuse any return if the product shows signs of wear and tear, or has been used or altered from its original condition in any way; alternatively, we may reduce the amount of any applicable refund accordingly.

(d) Non-refundable items

Products that have been customized for you in any way are non-refundable. Writing instruments that have been filled with ink, as well as bottles and refills that have been opened, cannot be returned to us.

(e) Refunds

Only the purchaser is eligible for a refund of the purchase price. A person who received the product as a gift (i.e., the "Gift Recipient") is under no circumstances eligible for a refund.

If the return complies with these Terms of Sale, we will make reasonable efforts to refund the purchase price to the buyer using the same payment method used for the original transaction within fourteen (14) days of receiving the returned product. The original shipping costs will be refunded.

7. Personal Information

All personal data is confidential and is collected via the contact form, the newsletter, or when creating an account on the Marionnette.fr website. We require this information to ensure the smooth processing of transactions, as well as to analyze customer behavior in order to improve the site’s usability and user experience, and to tailor the information we provide to customers.

At any time, the customer may access their personal data and has the right to modify it, in accordance with the amended Data Protection Act of January 6, 1978.

8. Intellectual Property

All content on the Marionnette.fr website is and remains the exclusive intellectual property of La Vivandière. No one is authorized to reproduce, exploit, redistribute, or use, in any capacity whatsoever—even in part—any content from the website, whether it consists of software, visual elements, or audio.

9. Disclaimer

We shall not be held liable for any failure to fulfill our obligations under these Terms and Conditions of Sale that is caused by events beyond our control and/or resulting from a force majeure event recognized as such by the French courts.

10. Governing Law

These Terms and Conditions of Sale are governed by French law and are subject exclusively to the jurisdiction of the French courts. Furthermore, only the French-language version of these Terms and Conditions shall be deemed authentic.

These provisions are governed by French law, in accordance with the Consumer Code regarding distance selling, through regulations based on Articles L121-16 to L121-21 and incorporating Directive 97/7/EC of May 20, 1997, on the protection of consumers in respect of distance contracts.

In the event of a dispute or complaint, the buyer shall first contact the seller to seek an amicable resolution.
